The Forum Company maintains the right to modify these Terms and Conditions of Use and may do so by posting notice of such modifications on this page. The Forum Company may, in its sole discretion, terminate or suspend your access to and use of this Site without notice and for any reason, including violation of these Terms and Conditions of Use or other conduct which the Legal Affairs Department, in its sole discretion, believes is unlawful or harmful to others. In the event of termination, you will no longer be authorized to access the Site, and The Forum Company will use any means possible or necessary to enforce this termination.

Links to Other Sites

Some links on the Site lead to websites that are not operated by the Legal Affairs Department. The Forum Company is not responsible for these websites, nor does it review or control their content. The Forum Company provides these links to users for convenience only. These links are not an endorsement of products, services, or information and do not imply an association between The Forum Company and the operators of the linked website. When you select a link to an outside website, you are subject to the terms and conditions of the owner/sponsors of that outside website.

Unless otherwise stated, you may download, store and/or use the website material for your own personal use and/or research purposes only. You may not, however, republish, retransmit, redistribute or otherwise make the material available to any other party or make the same available on any website, on-line service or bulletin board of your own or of any other party or make the same available in hard copy or on any other media or commercially exploit such material in any manner without The Forum Company express prior written consent. The Forum Company reserves the right to monitor any content that you provide, but shall not be obligated to do so. Although it cannot monitor all postings or information entered into the Site, The Forum Company reserves the right (but assumes no obligation) to delete, move or edit any postings that violate these Terms and Conditions of Use. United Arab Emirates and foreign copyright laws and international conventions protect the contents of the Site. You agree to abide by all copyright notices posted on the Site.

Indemnity

You agree to defend, indemnify and hold harmless The Forum Company and all of its employees and agents from any and all liabilities incurred in connection with any claim arising from any breach by you of these Terms and Conditions of Use, including reasonable legal fees and costs. You agree to co-operate fully in the defense of any such claims. The Forum Company reserves the right to assume, at its own expense, the exclusive defense and control of any matter otherwise subject to indemnification by you. You agree not to settle any matter subject to this indemnity without the written consent of the Legal Affairs Department.

Disclaimer of Warranty

You expressly understand and agree that your use of, and access to, the Site or any material available through this Site is at your own risk. Neither The Forum Company nor its employees warrant that the Site or its content, including downloadable content, will be uninterrupted, problem-free, omission-free or error-free; nor do they make any warranty as to the results that may be obtained from the use of the Site. The content and function of the Site are provided to you “as is,” without warranties of any kind, either express or implied, including but not limited to warranties of title, merchantability, fitness for a particular purpose or use or currency.

Limitation of Liability

In no event will The Forum Company or its employees be liable for any incidental, indirect, special, punitive, exemplary, or consequential damages arising out of your use of or inability to use the Site, including without limitation loss of revenue or anticipated profits, loss of goodwill, loss of business, loss of data, computer failure or malfunction, or any other damages.

OUR INTELLECTUAL PROPERTY

Unless otherwise stated, all creative works, text, data, software links, audio content, audiovisual content, footage, graphics, images (photographs), illustrations, forms and look and feel attributes, The Forum Company trade mark and logos, copyrighted material and other intellectual property rights in all information, documents or material on the Website and any technology or code making up any The Forum Company widget (“Content”) are owned and/or controlled by The Forum Company or its licensors.
Any downloading, reproduction, republication, extraction, modification, copying, distribution, transmission, display or sale of Content or any other part of the Website without the express written consent of The Forum Company for any purpose is strictly prohibited.
If you breach any of the provisions in these Terms, in addition to all other legal remedies available, your permission to use the Website and your license to use the Content immediately and automatically terminates and you must immediately delete, return or destroy any downloaded or printed extracts of Content from the Website.
No content or any other part of the Website may be reproduced, republished, extracted, modified, copied, distributed, displayed, stored or otherwise included in any other website or any public or private electronic retrieval system or service without The Forum Company’s specific prior written permission.

Your use of the Website and Content and any other content made available through the Website is at your sole risk and discretion, and The Forum Company hereby disclaims any and all liability to you or any third party relating thereto.

Disputes arising in connection with these Terms or the Privacy Policy shall be subject to the exclusive jurisdiction of the courts of the Emirate of Abu Dhabi.
These Terms represent the entire understanding and agreement between The Forum Company and you concerning your use of the Website and the Content. Any and all previous courses of dealing, written or oral understandings, discussions, representations, correspondence and communications between The Forum Company and you relating to the matters covered by these Terms are hereby superseded. You hereby agree that you have not relied upon, and will have no remedy in respect of, any warranty, statement, representation or understanding made by any party including The Forum Company unless it is expressly set out in these Terms.

These Terms may be available in English and Arabic languages. For the avoidance of doubt the Arabic -language version shall at all times take precedence in the event of any discrepancy or for legal purposes.

It is permissible to stop and/or prevent and/or terminate the use of the site in the event of a violation by a user, or if there are reasons to believe that a user has violated and violated the terms and rules of use.
